TRAFFIC TICKET INFRACTIONS

Traffic infractions are what we more commonly know as traffic tickets, such as speeding tickets and stop sign violations. Traffic infractions are civil and not criminal violations of the law. That means a traffic infraction will not go on your criminal record and a person cannot go to jail for a traffic infraction. A person given a traffic infraction will be assessed a civil penalty, such as a fine, and that infraction can go on your driving record. Traffic infractions can affect your insurance, they can suspend or revoke your driver’s license, and they can suspend or revoke your CDL and affect your employment if you drive for a living. Delinquent fines can be sent into collections and affect your credit.

There are two types of traffic infractions, moving and non-moving violations. Moving violations, such as speeding tickets, stop sign tickets, and accident tickets, have a safety component. They are likely to impact your car insurance and they can suspend your driver’s license. Non-moving violations, such as expired license plate tabs and parking tickets, are not considered to have a safety component and are not likely to affect your car insurance or driver’s license. The tricky part of traffic infractions, is that all moving violations and most non-moving violations are reported on your driving record. Even if a non-moving violation in itself is not likely to affect your insurance, it can affect your insurance if you have similar violations, or you have a combination of moving and non-moving infractions on your driving record already. More so, what constitutes a moving versus a non-moving violation often defies common sense. For example, many people do not realize camera enforced speeding tickets are processed like parking infractions, are classified as non-moving violations, and do not get reported on your driving record.

Given all the complexities of traffic law you should not immediately pay a traffic ticket because you might not want to face the consequences later on. It is better to know what you are facing from the beginning than to be begging for forgiveness later on. CRIMINAL TRAFFIC

Most people who are pulled over think they are just getting a traffic ticket and a fine. Many of these same people are dumbfounded when they are told by the police officer to get out of the car, placed in handcuffs, and their cars towed away. Maybe you drove a little too fast in heavy traffic or your passengers had too much to drink and you were just trying to do the responsible thing. You could have been flustered that night and you had a little bit of an attitude toward the officer. You were given a criminal ticket but not communicated by the police officer that you have a court date. Now you missed that court date and you have a $10,000.00 warrant for your arrest.

The point is, criminal Traffic Misdemeanors are harsher than necessary and many drivers are overcharged with serious criminal tickets or multiple traffic infractions. Most of our clients are everyday good people that have made big mistakes with serious consequences. LICENSE SUSPENSIONS

Traffic infractions and criminal tickets can cause driver’s license suspensions and revocations. However, Washington State does not have a driving violations point system like most other States. Washington Department Of Licensing (DOL) suspends on a set criteria that takes into account a person’s driving record. For instance, a driver can receive a 60 day license suspension if that driver is convicted of 6 moving traffic infractions within a 1 year period. That same person can have their license revoked for 7 years as a habitual traffic offender (HTO) with 3 convictions for criminal tickets in a 5 year period. Suspension times vary and are aggravated depending on the type of traffic ticket and the number of violations.

CDL and intermediate license holders have even more stringent requirements. If you hold a CDL, 2 major moving violations in a 3 year period will cause a 60 days CDL license suspension. If you have an intermediate license, 2 moving infractions can cause a license suspension, whereas a third will revoke your license until you turn 18. If you just received a new ticket and you are walking on egg shells, do not pay that ticket because you may lose your license and little can be done about that once the ticket is made. COMMERCIAL DRIVER’S LICENSE (CDL)

A commercial driver’s license (CDL) likely means you drive for a living. You work a in a highly regulated industry, which comes with it good wages, job stability, and benefits for yourself and your family. Driving is how you make your living and it is your career. You do not want to let that traffic ticket affect your way of life.

CDLs do not realize the serious licensing ramifications moving violations can have. For example, any speeding ticket 15 MPH or over the speed limit can be counted as a major moving violation. 3 major moving violations in a 3 year period can cause a 60 day CDL license suspension. If you were transporting hazardous materials, that disqualification is for 3 years. A conviction for DUI will lead to a 1 year disqualification. If you are convicted again, your CDL will be disqualified for life.

There are a slew of issues, which pertain to CDL holders than any other driver on the road. Since you drive thousands of more miles a year than the average person, and you may be transporting persons and sensitive cargo on the way, you are simply held to a higher standard of responsibility than anyone else on the road. Because you drive more than the average person, you are more likely to get a traffic ticket no matter how good of a driver you are. Don’t beat yourself too much about it. MISDEMEANORS

Typical everyday people get misdemeanors. These can be crimes of intent or recklessness. Many people do not even realize they committed a misdemeanor offense until they are charged. Some people are left wondering why they were even given a misdemeanor to begin with and are perplexed their specific offense was even a crime and not a civil infraction.

Misdemeanors are crimes with a maximum penalty of 364 days in jail with a $5000.00 fine. Simple misdemeanors have a miximum penalty of 90 days in jail and a $1000.00 fine. Misdemeanors are the most common of crimes and are typically prosecuted in District and Municipal Courts of Limited Jurisdiction. Relax, you are not a “felon” if you received a misdemeanor. You are not going to prison where they throw away the key (although you can serve time in a county jail), you do not lose your right to vote as with a felony, and many misdemeanors can be dismissed or reduced into infractions. Some jail penalties can be served in alternatives such as electronic home monitoring (EHM) or work crew.
